    General Terms and Conditions (GTC)

    § 1 Scope and Provider

    (1) These General Terms and Conditions apply to all orders placed by consumers and businesses through our online shop.

    (2) The provider and contractual partner is:

    (3) A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business within the meaning of these GTC is a natural or legal person or a partnership with legal capacity acting in the exercise of its commercial or self-employed professional activity when entering into a legal transaction.

    (4) Any deviating terms and conditions of the customer shall not be accepted unless we have expressly agreed to their validity in writing.

    (5) The contract language is German. If we provide these GTC or other contractual texts in an additional language, the German version shall prevail in the event of any conflict of interpretation.

    (6) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

    § 2 Conclusion of Contract

    (1) The presentation of products in our online shop does not constitute a legally binding offer but rather a non-binding invitation to place an order.

    (2) By clicking the order button, the customer submits a binding order for the goods contained in the shopping cart.

    (3) Immediately after submitting the order, the customer will receive an automatic confirmation by email in which the order is listed again. This automatic confirmation merely documents that the order has been received by us and does not constitute acceptance of the contractual offer.

    (4) A contract is only concluded when we expressly accept the order by means of an order confirmation or by dispatching the goods to the customer.

    (5) If a payment method with immediate payment processing is selected, in particular via Shopify Payments, PayPal, Shop Pay, credit card, Apple Pay, Google Pay, Bancontact, EPS, iDEAL, Wero, Klarna, or similar instant payment methods, the contract shall be concluded, notwithstanding paragraph 4, as soon as the customer initiates the payment process in a binding manner during checkout.

    (6) We are entitled to reject orders without stating reasons, in particular if there is justified suspicion that the ordered goods are intended for commercial resale.

    § 3 Prices and Shipping Costs

    (1) The prices stated in the online shop at the time of the order shall apply. All prices are final prices and include the applicable statutory VAT.

    (2) Additional shipping costs may apply. These will be clearly communicated to the customer during the ordering process.

    (3) For deliveries to countries outside the European Union, additional costs may arise in individual cases for which we are not responsible and which are to be borne by the customer. These include, in particular, import duties, customs charges, taxes, or fees charged by financial institutions.

    § 4 Storage of the Contract Text

    (1) We store the text of the contract.

    (2) The order data and these GTC are displayed to the customer during the ordering process. After completion of the order, the customer receives the order data by email.

    (3) Previous orders may be viewed in the customer account, if such an account has been created.

    § 5 Delivery, Availability and Shipping

    (1) Delivery shall be made to the delivery address specified by the customer.

    (2) Delivery times are communicated to the customer in the respective offer or at the latest during the ordering process. Unless otherwise stated, the delivery time for goods ready for dispatch is approximately 2 to 5 business days within Germany, approximately 3 to 7 business days within Europe, and up to 21 business days for international deliveries. The delivery times stated during the ordering process or on the respective product page shall always prevail.

    (3) If individual products are marked as pre-order, made to order, or not immediately available, the delivery times stated on the respective product page shall apply.

    (4) If not all ordered products are in stock, we are entitled to make partial deliveries, provided this is reasonable for the customer. No additional shipping costs shall be charged to the customer as a result.

    (5) If an ordered product is temporarily unavailable, we shall inform the customer without undue delay and communicate the expected delivery time.

    (6) If an ordered product is permanently unavailable, we are entitled to withdraw from the contract. In this case, we shall inform the customer without undue delay and refund any payments already made without undue delay.

    (7) If the shipping company returns the goods to us because delivery to the customer was not possible, the customer shall bear the costs of the unsuccessful shipment unless the customer is not responsible for the circumstance that made delivery impossible, or unless the customer was temporarily prevented from accepting the delivery, unless we had announced the delivery to the customer within a reasonable period in advance.

    (8) The customer is requested to report any obvious transport damage directly to the carrier and to inform us accordingly. Failure to do so shall have no effect on the customer’s statutory warranty rights.

    § 6 Payment Terms

    (1) Payment shall be made using the payment methods offered in the online shop at the customer’s choice.

    (2) We accept payments in particular via Shopify Payments as well as other payment methods displayed during checkout. The currently offered payment methods may in particular include: Shop Pay, Visa, Mastercard, American Express, Maestro, UnionPay, Apple Pay, Google Pay, Bancontact, EPS, iDEAL, Wero, Klarna, and PayPal.

    (3) The payment methods actually available shall be bindingly displayed to the customer during the ordering process. We reserve the right not to offer certain payment methods in individual cases.

    (4) The purchase price is due immediately upon conclusion of the contract.

    (5) Gift cards and promotional codes may only be redeemed in accordance with the respective terms communicated for them.

    (6) Only one promotional code may be redeemed per order unless otherwise stated in the relevant offer.

    (7) Cash payment of gift cards or promotional codes is excluded unless mandatory statutory provisions provide otherwise.

    § 7 Gift Cards and Promotional Codes

    (1) Gift cards are valid for an unlimited period from the date of purchase unless otherwise stated at the time of purchase.

    (2) Gift cards may only be redeemed for the purchase of goods. Redemption for services or for the purchase of additional gift cards is excluded.

    (3) If the value of a gift card is insufficient to cover the order, the difference may be paid using one of the offered payment methods.

    (4) Promotional codes may only be redeemed within the specified period and in accordance with the terms communicated in each case.

    (5) Unless expressly stated otherwise, promotional codes cannot be combined with other discount promotions.

    (6) If an order placed using a promotional code is effectively cancelled in whole or in part or if items are returned, there is no entitlement to a renewed grant or reimbursement of the promotional code, provided that it is a promotional discount code granted free of charge.

    § 8 Retention of Title

    The goods shall remain our property until full payment has been made.

    § 9 Right of Withdrawal for Consumers

    (1) Consumers generally have a statutory right of withdrawal for distance selling contracts.

    (2) The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

    (3) The statutory right of withdrawal is not excluded by discount promotions, sale promotions, or the use of a promotional code, unless a statutory exclusion applies.

    (4) Further information on the right of withdrawal can be found in our separate cancellation policy.

    § 10 Product Characteristics and Presentation

    (1) Our products are pieces of jewellery made of precious metals and may in part be set with natural stones, gemstones, diamonds, or other materials.

    (2) Minor deviations in colour, structure, grain, surface, size, weight, or stone characteristics are due to the nature of the materials and manufacturing process and shall not constitute a defect, provided that such deviations are reasonable for the customer and do not materially impair the agreed characteristics of the product.

    (3) With natural materials, in particular gemstones, pearls, and other natural products, natural variations in colour, inclusions, structure, and appearance may occur.

    (4) Product images in the online shop are for illustrative purposes only. Depending on screen settings and technical display conditions, slight deviations may occur between the photographic representation and the actual product.

    § 11 Warranty

    (1) The statutory warranty rights shall apply.

    (2) In addition, the following shall apply to businesses:
    a) Obvious defects must be inspected by the business without undue delay after receipt of the goods and reported to us without undue delay.
    b) Section 377 of the German Commercial Code (HGB) applies to merchants.
    c) The limitation period for defect claims for new goods is one year from delivery of the goods, unless mandatory statutory provisions provide otherwise or claims relate to intent, gross negligence, injury to life, body, or health.

    § 12 Liability

    (1) We shall be liable without limitation for intent and gross negligence.

    (2) In the event of a slightly negligent breach of essential contractual obligations, our liability shall be limited to the foreseeable damage typical for the contract. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.

    (3) Any further liability for slightly negligent breaches of duty is excluded.

    (4) The above limitations of liability shall not apply in the event of injury to life, body, or health, fraudulent concealment of a defect, assumption of a guarantee, or liability under the German Product Liability Act.

    (5) To the extent that our liability is excluded or limited, this shall also apply to the personal liability of our legal representatives, employees, and vicarious agents.

    § 13 Governing Law

    (1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

    (2) In relation to consumers, this choice of law shall only apply insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

    § 14 Final Provisions

    (1) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and us shall be our registered office.

    (2) Should individual provisions of these GTC be wholly or partially invalid or become invalid, the validity of the remaining provisions shall remain unaffected.
